PRODUCT INFORMATION

The products displayed on this site are available from Downtown Shirt Company, but some items availability varies by supplier. We reserve the right to substitute any product listed with one of similar style and quality in the best interest of the customer at any time in order to complete the job as ordered and in the time frame specified. The prices displayed in this site are quoted in U.S. Dollars and are valid only in the United States.

PRODUCT DISPLAY AND COLOR REPRODUCTION

We have made every effort to display our products that appear at the Site as accurately as possible. However, the actual colors you see depend on your particular computer monitor. Therefore, we cannot guarantee that your monitor's display of any color or texture or detail of actual merchandise will be accurate.

DELIVERIES:

Delivery of the goods by the Seller to the carrier at the point of origin shall constitute delivery of the goods to the Buyer and thereafter the shipment of the goods shall be at the Buyer's risk. All claims and allowances for damage to the merchandise incurred in transit must be filed against and presented to the carrier by the Buyer. All cost of freight, transportation, or mailing and all demurrage charges shall be paid by the Buyer. Normally we produce your re-order within 10-14 working days. Custom Orders may take longer. Orders placed in Montrose, Colorado will be on a "picked up" basis unless otherwise specified.

RETURNS:
We will not accept any returns without an official return authorization number written on your return package(s). We will not accept any garments with defects after they have been imprinted. We will not accept returns on any personalized order. All returns must be made within 48 hours after receiving goods. Upon receipt of your returned merchandise, we will issue a credit or exchange. Return freight is the sole responsibility of the customer. Buyer shall in no event return any goods to Seller unless expressly authorized to do so in writing by the Seller. REFUNDS ARE RESTRICTED TO THE ACTUAL COST OF THE ITEM PURCHASED, NO OTHER ITEMS REFUNDED.

PRICES-TERMS-POLICY CHANGES:

are subject to change without prior notice. WE ARE NOT RESPONSIBLE FOR CUSTOMER TYPOGRAPHICAL ERRORS. All sales will be limited to the terms and conditions contained herein. Any objection by Buyer of the terms contained herein shall be deemed to have been waived if we do not receive the objection in writing within 3 days of receipt of the invoice or acknowledgement or before part or the merchandise or services is accepted by Buyer, whichever may occur first.

LOST OR STOLEN DELIVERIES:
Downtown Shirt Company is not responsible for lost or stolen merchandise orders once same is picked-up/shipped to customer via a legally recognized U.S. Shipper/business associate and legal shipping documents are on file as proof of such shipment

CUSTOM DESIGNS:
Custom Artwork and Graphic Logos designed by us for the customer will remain the property of Downtown Shirt Company; at it's discretion, Downtown Shirt Company will grant the customer rights to use such material in other formats. The customer must obtain permission and rights to use any information or files that are copyright by a third party; the customer is further responsible for granting Downtown Shirt Company permission and rights for use of same. INDEMNITY: The customer agrees to indemnify and hold harmless Downtown Shirt Company from any and all claims resulting from the customer's use of Downtown Shirt Company's services which cause damage to the customer or a third party. NOTICE: Downtown Shirt Company's services may be used only for lawful purposes, this includes any materials judged threatening or obscene.

ACCEPTABLE UPLOAD FILES: CDR, PCX, TIFF, EPS, JPG, GIF, and BMP. CALL ON ANY OTHERS

WARRANTY DISCLAIMER: All products made by Seller are inspected before shipment. If any goods prove to have been defective in material or workmanship at the time of shipment, and a claim is made by Buyer, Seller will repair or replace the goods, at the Seller's sole option. Unless otherwise agreed by Seller in writing, Seller makes no warranties, expressed or implied. DOWNTOWN SHIRT COMPANY SHALL NOT BE LIABLE FOR SPECIAL, INCIDENTAL, CONSEQUENTIAL, INDIRECT OR OTHER SIMILAR DAMAGES ARISING FROM BREACH OF WARRANTY, BREACH OF CONTRACT, OR ANY OTHER LEGAL THEORY, EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. DOWNTOWN SHIRT COMPANY DISCLAIMS ANY EXPRESS WARRANTIES AND ANY IMPLIED WARRANTIES COVERING SALES HEREUNDER, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

TELEPHONE ORDERS: Downtown Shirt Company will not be responsible for any discrepeancies on telephone orders. All telepohone orders placed must be followed up with a written copy either by Fax, Email or Snail Mail, if requested by us at the time of order.

MINIMUMS: None required on re-orders, first time Business orders require $50 purchase. Please Call, email or fax us for a quote on all Specialized orders.
